TERMS OF SERVICE

Calvary Design Studio
Effective Date: 08/14/2026

1. Acceptance of Terms

By engaging Calvary Design Studio ("Studio," "we," "us," or "our") for design, website, or related creative services, the client ("Client," "you") agrees to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not engage our services.

2. Services Provided

Calvary Design Studio provides website design and development services (including but not limited to Squarespace website builds), graphic design, branding, and related creative services. Services are offered through the following package tiers, as well as custom-scoped engagements:

  • Basic Design Package

  • Ultimate Design Package

  • Custom Design Package (fully scoped per project)

The specific deliverables, timeline, and price for each project will be outlined in a project proposal, invoice, or written agreement ("Project Agreement") provided to the Client prior to the commencement of work. In the event of any conflict between these Terms and a Project Agreement, the Project Agreement will govern for that specific project.

3. Fixed-Scope, Fixed-Deadline Model

Calvary Design Studio operates on a fixed-scope, fixed-deadline basis. This means that, prior to beginning work, the Studio and Client will agree upon a defined scope of deliverables and a target completion date. The Studio commits to completing the agreed-upon scope by the agreed-upon completion date, provided the Client meets their responsibilities under Section 5 (Client Responsibilities) in a timely manner.

Any request that falls outside the agreed-upon scope — including but not limited to additional pages, buttons, graphics, revisions beyond those included in the package, SEO work, or any other addition not explicitly listed in the Project Agreement — will be treated as an add-on and billed separately at a rate starting at $100/hour, as further outlined in Section 4.

4. Pricing, Payment, and Add-Ons

Package pricing is outlined in the Studio's current rate sheet or Project Agreement at the time of engagement. Pricing is subject to change for future projects but will not change mid-project for an active, agreed-upon engagement without Client consent.

  • A 60% deposit is required prior to the commencement of work. This deposit secures the Client's completion date on the Studio's project schedule.

  • The remaining balance is due according to the payment schedule outlined in the Project Agreement.

  • Any work requested outside the agreed scope starts at $100/hour and will be confirmed with the Client in writing (including via email) before additional work begins.

  • Late payments may result in a pause of work until payment is received.

5. Client Responsibilities

To meet agreed-upon deadlines, the Client agrees to:

  • Provide requested content (text, images, logos, branding materials, account access, etc.) in a timely manner

  • Respond to requests for feedback or approval within a reasonable timeframe

  • Provide revision feedback within the number of rounds included in their package

Delays in Client responsiveness or content delivery may result in the completion date being extended accordingly. The Studio is not responsible for missed deadlines caused by Client delay.

6. Revisions

Each package includes a defined number of revision rounds per page, as outlined in the Project Agreement. Revisions requested beyond the included rounds will be billed at the add-on rate described in Section 4.

7. Intellectual Property

Upon full payment for a project, the Client will own the final delivered website design, graphics, and other agreed-upon deliverables created specifically for that project. Calvary Design Studio retains the right to:

  • Display the completed work in its portfolio, website, and marketing materials

  • Retain and reuse general design techniques, layouts, and non-client-specific processes developed during the course of the engagement

Any third-party assets used in a project (stock photography, fonts, plugins, templates, etc.) remain subject to their original licensing terms and are not owned by either party beyond the scope of that license.

8. Platform and Hosting

Calvary Design Studio designs and builds websites primarily on the Squarespace platform. The Studio is not responsible for Squarespace's platform fees, hosting costs, uptime, outages, or changes to Squarespace's features or pricing. Client is responsible for maintaining an active Squarespace subscription both during and after the project.

9. Post-Project Handover

At the conclusion of a project, the Studio will provide the Client with a full handover and walkthrough covering the use and maintenance of their website. Following handover, the Client assumes full responsibility for maintaining, updating, and securing their website unless a separate maintenance agreement is in place.

10. Cancellations and Refunds

Should a Client wish to cancel a project after work has begun, the Client is responsible for payment for all work completed up to the date of cancellation. Deposits are non-refundable once work has commenced, as they secure the Studio's availability and reserved project timeline.

11. Limitation of Liability

Calvary Design Studio will perform services with reasonable skill and care. However, the Studio is not liable for any indirect, incidental, or consequential damages arising from the use of the website or deliverables, including but not limited to lost profits, lost data, or business interruption. The Studio's total liability for any claim arising from a project will not exceed the total amount paid by the Client for that project.

12. Third-Party Tools and Integrations

Projects may involve third-party tools, plugins, or integrations (such as booking schedulers, email marketing platforms, or payment processors). The Studio is not responsible for the performance, security, or continued availability of third-party services.

13. Termination

Calvary Design Studio reserves the right to terminate or pause a project in the event of non-payment, lack of Client responsiveness beyond a reasonable period, or conduct that is abusive or unreasonable toward Studio staff.

14. Governing Law

These Terms shall be governed by the laws of the State of Oklahoma, without regard to its conflict of law provisions.

15. Changes to These Terms

Calvary Design Studio may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms. Active projects will be governed by the Terms in effect at the time the Project Agreement was signed, unless otherwise agreed.
